Terms and Conditions – PulseFusion App

1. Scope & Definitions

PulseFusion GmbH (hereinafter referred to as "we", "us", or "PulseFusion") provides you with an app that connects athletes, integrates training data, offers challenges, and builds a fitness community. The PulseFusion App (hereinafter "App") is available for iOS and Android platforms. These terms and conditions govern the services we provide to you as a user.

 These terms apply exclusively. Conflicting or differing terms from the user will not be accepted unless expressly agreed upon in writing.

2. Description of Services

The PulseFusion App includes the following core features:
1. Creating a personal profile with fitness data and interests
2. Participating in local and global fitness challenges
3. Connecting with groups, studios, brands, and coaches
4. Importing and analyzing fitness data from third-party services (e.g., Apple Health, Strava, Garmin)
5. Accessing newsfeeds, rankings, events, and community features
We reserve the right to modify, extend, or remove features at any time, including paid features, in order to improve the app and user experience.

3. Liability and Disclaimer

3.1 Use of the app is at your own risk. We recommend consulting a doctor before starting any training program or challenge. PulseFusion is not a substitute for medical advice.
3.2 We do not guarantee the accuracy or completeness of recommendations, evaluations, or training plans based on general data models. Individual health and fitness may vary.
3.3 We are liable only in cases of intent and gross negligence, or for damages resulting from injury to life, body, or health. For minor negligence, liability is limited to essential contractual obligations and foreseeable damages.

4. Registration and Contract

4.1 By registering via email, Apple, or Google ID and accepting these terms and our privacy policy, you enter into a user agreement with us.
4.2 We reserve the right to reject registrations without providing reasons. Any submitted data will be deleted in such cases.

5. Misuse

5.1 You agree to protect your account against unauthorized access. If you suspect misuse, notify us immediately at support@pulsefusion.app.
5.2 In cases of confirmed misuse, we reserve the right to suspend or delete the account. No refunds will be issued for periods before the notification.

6. Fees and Payment

6.1 The PulseFusion App is completely free for end users. No fees apply for registration, use, or participation in challenges.
6.2 Paid offerings are intended exclusively for brands, gyms, event organizers, and coaches. These may book business accounts, advertising
6.3 Users who are not acting as business partners are not subject to payment obligations. Any unintentional purchase of a paid account by private individuals can be revoked within 14 days.

7. Availability

We strive to maintain uninterrupted availability of the app, but we do not guarantee permanent or error-free operation.

8. Termination

You can cancel your user account at any time via the app or by emailing support@pulsefusion.app. Ongoing subscriptions must be cancelled via the App Store. Upon cancellation, your profile will be deleted according to our privacy policy.

11. Final Provisions

11.1 These terms are governed by the laws of the Federal Republic of Germany.
11.2 We reserve the right to update these terms. In case of significant changes, we will inform you via app or email. Continued use of the app constitutes acceptance of the new terms.
11.3 If individual provisions are invalid, the validity of the remaining terms remains unaffected.
11.4 The EU provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings.
